OH NO! IT’S DEVO! WITH A SUBPOENA!
Jun. 30th, 2008 11:34 amITEM: Devo is suing McDonald’s over “New Wave Nigel”, an “American Idol” tie-in toy that sports a Devo energy dome hat.
Like so.

The lawsuit might be a bit much – to be fair, the Devo hat IS synonymous with the 80s (though personally, I would never describe Devo’s music as “new wave” – they’re from Ohio, for one thing), and I’m betting whoever designed Nigel probably didn’t bother to check to see if the hat design was trademarked.
Still, after all the silly lawsuits that McD’s has inflicted on anyone who has ever launched any restaurant or product with a “Mc” prefix in it, it’s refreshing to see someone turn the tables on them.
But then I'm a Devo fan, and I think American Idol is proof that Devo was right about human evolution, so I would say that, wouldn't I?
Q: Are we not men?
A: We are dF!

“[T]he red hat is exactly the red hat that I designed, and it's copyrighted and trademarked,” says Jerry Casale. "They didn't ask us anything. Plus, we don't like McDonald's, and we don't like American Idol, so we're doubly offended."
